In a recent statement, former acting ICE Director Tom Homan expressed frustration that many individuals in immigrant communities are aware of their constitutional rights. He claimed that this knowledge makes it more difficult for ICE agents to do their jobs, as people are empowered to assert their rights when confronted by immigration enforcement. While Homan’s statement suggests that knowing one’s rights hinders law enforcement, the reality is that understanding and exercising one’s rights is fundamental in a democratic society.

At Joseph & Hall, we believe that every person, regardless of their immigration status, has the right to be informed and to protect themselves against unlawful enforcement actions. This belief was reinforced when 9News recently visited our office to interview one of our Partners, Aaron Hall, about what individuals in the community should do if ICE shows up to question them about their immigration status. Exercising one’s rights is not about obstructing justice; it is about ensuring that justice is applied lawfully and fairly. The Constitution provides protections to all individuals, including the right to remain silent, the right to refuse consent to a search, and the right to legal representation. When ICE agents conduct enforcement actions, they must do so within the limits of these constitutional protections. Being informed does not mean breaking the law—it means ensuring that the law is upheld fairly.
