Eligibility Requirements for T Visas

The T visa was created to protect victims of severe forms of human trafficking while allowing them to remain in the United States to assist law enforcement in investigating and prosecuting human trafficking cases. You may be eligible for a T visa if you can demonstrate that you:

  1. Are a Victim of Trafficking: You have been subjected to sex trafficking or labor trafficking (including indentured servitude and debt bondage).
  2. Are Physically Present in the U.S.: You are in the United States, in an American territory, or at a port of entry due to trafficking.
  3. Have Assisted Law Enforcement: You have complied with any reasonable requests from law enforcement agencies for assistance in the investigation or prosecution of human trafficking (exceptions apply for minors under 18 or those unable to cooperate due to trauma).
  4. Would Suffer Extreme Hardship: You would face “extreme hardship involving unusual and severe harm” if you were deported from the United States.

Protections and Benefits Available to T Visa Holders

A T visa offers immediate relief and essential protections to help you rebuild your life in a secure environment.

  • Lawful Status: You are granted temporary lawful status to remain safely in the United States, providing immediate protection from deportation.
  • Employment Authorization: T visa holders are eligible for an Employment Authorization Document (EAD), granting the ability to work legally and gain financial independence.
  • Access to Services: You may become eligible for certain federal and state benefits and services, such as refugee assistance programs or housing support.

T Visa Duration and Path to Permanent Residency

A T visa is generally granted for a period of up to four years. However, this temporary status is not necessarily the end of your journey, as the T visa also provides a direct path to permanent residency (a green card). After maintaining continuous physical presence in the United States for three years in T nonimmigrant status, you may become eligible to apply for lawful permanent residency. Family Members Who May Qualify for Derivative Status

The trauma of trafficking affects entire families, and the T visa recognizes this by allowing certain family members to obtain derivative T visas.

  • Parents (if you are under 21 years of age)
  • Unmarried siblings under 18 years of age (if you are under 21)

This allows you to also protect your loved ones, allowing your family to heal and move forward together in safety.
