Updates to Medical Examination and Vaccination Requirements for I-485 Applications

U.S. Citizenship and Immigration Services (USCIS) has recently implemented several changes to the medical examination requirements for Form I-485, Application to Register Permanent Residence or Adjust Status. Staying informed about these updates is crucial for applicants to ensure compliance and avoid potential delays in their application process.

1. Removal of 60-Day Signature Requirement for Form I-693

On April 4, 2024, USCIS issued policy guidance stating that a Form I-693, Report of Immigration Medical Examination and Vaccination Record, properly completed and signed by a civil surgeon on or after November 1, 2023, does not expire and may be used indefinitely as evidence. This change eliminates the previous requirement for the civil surgeon’s signature to be dated no more than 60 days before the applicant filed the Form I-485. Applicants can now submit Form I-693 without concern for its expiration, provided it meets the specified criteria.

2. Form I-693 Required with Form I-485 Filing

Effective December 2, 2024, USCIS requires certain applicants filing Form I-485 to submit Form I-693 concurrently with their application. Failure to include the medical examination report may result in the rejection of the Form I-485. This policy aims to streamline the adjudication process by ensuring that all necessary documentation is available at the time of filing.

3. COVID-19 Vaccination No Longer Required

As of January 22, 2025, USCIS has waived the requirement for applicants seeking adjustment of status to provide documentation of COVID-19 vaccination on Form I-693. USCIS states it will not issue Requests for Evidence (RFEs) or Notices of Intent to Deny (NOIDs) related to COVID-19 vaccination proof. This update reflects the evolving public health guidelines and reduces the burden on applicants concerning COVID-19 vaccination documentation.

These recent policy changes by USCIS are designed to simplify the application process for adjustment of status. Applicants should ensure they are using the most current forms and adhere to the latest guidelines to prevent delays or rejections.
