Minimum Investment Amounts Raised for International Entrepreneur Rule

USCIS has updated the minimum investment amount required for immigrant investors to enter the United States under the “International Entrepreneur Rule.”  This threshold has been increased, in most relevant part to $311,071 from $264,147.

While this increase is notable, what perhaps is more notable is that this program is all but nonexistent.  As USCIS statistics have shown, since the program’s inception in 2018, a grand total of 112 applications under this program have been filed—an average of 19 a year.   These abysmally small numbers show that the program requirements are frankly unworkable, and the minimum investment threshold is hardly the roadblock for others to use the program.  The required criteria as a whole simply make the program effectively inoperable.

Instead, immigrant investors in the U.S. would likely be better served exploring alternative options, such as the E-2 Treaty Investor visa, the EB-5 Immigrant Investor visa, or, in some cases, an L-1A Multinational Manager or Executive visa.
