The Immigration Process

The US immigration process is complex, even for the simplest of matters. It is often said the US immigration law is surpassed only by the US tax code, which is the most complex and often confusing law in the country. There are different things that happen in the immigration process, depending on your individual circumstance and whether your situation is individual, family or employment related. 

  • Individual Issues. Most immigration cases involve others, such as a family member or employer, generally known as “sponsors.” However, there are many situations where one does not need a sponsor, but they can sponsor themselves usually for a green card. These are situations such as seeking asylum, seeking protection from deportation as a member of a vulnerable population, or obtaining a green card based on investing in the United States.   • Employment Issues. Unless you are a U.S. citizen or green card holder, you must have the authorization to work legally in the United States. Therefore, if you wish to work in the US or if you are an American employer wishing to hire a foreign worker, you must first obtain authorization from the United States Citizenship and Immigration Service (USCIS). The process of obtaining this authorization is no easy walk in the park. Rather, it is complicated and riddled with a maze of laws, rules, and regulations that must be satisfied before one is approved for a work visa or authorization.
  • Family Issues. US immigration law allows certain family members of US citizens or those of US permanent residents (green card holders) to be given green cards of their own. Not all family members qualify, but those who do are typically spouses, children, siblings, and parents of the US citizen or green card holder.
