An immigration deadline falls on a Sunday. Can you file on Monday? Sometimes, but USCIS is changing when that extra day is available.
On September 23, 2026, USCIS announced updated guidance on weekend and holiday filing deadlines. The policy applies to paper filings received on or after October 23, 2026. If you have an upcoming filing, check how the deadline is calculated before assuming you have until Monday.
USCIS is narrowing a policy it adopted in 2023. Under the updated guidance, the next business day rule applies to paper filings when a statute, regulation, or form instruction sets a deadline as a specific number of days. Deadlines tied to an eligibility requirement, such as being under a certain age, do not get the same extension.
For example, a motion to reopen an I-485 denial generally must be filed on Form I-290B within 30 days, or 33 days if USCIS mails the decision. If the final day for that paper filing is a Sunday, USCIS can receive it Monday, unless Monday is a federal holiday. In that case, the deadline moves to the next business day.
Weekends and federal holidays still count when calculating the filing period. The adjustment applies when the last day falls on one of those days.
An age cutoff works differently. USCIS uses the example of a person applying for special immigrant juvenile classification, which requires filing before turning 21. If that birthday falls on Sunday, the petition must still be received before the birthday. Waiting until Monday is too late.
Employers should also review status expiration dates separately from response deadlines. If an H-1B employee’s I-94 expires on a Saturday, plan for USCIS to receive the extension of stay request before that expiration. Do not assume Monday delivery will be timely.
Electronic filings do not receive this weekend or holiday extension. USCIS treats them as received immediately upon submission. If your online filing is due Sunday, submit it by the applicable Sunday deadline. Check the filing system’s time zone before submitting.
Before filing, confirm the deadline, the filing method, and when USCIS must receive the documents. For a receipt-based deadline, mailing the package on the due date is generally not enough. Leave time for delivery and any missing documents.
