The Trump administration has intensified its immigration enforcement efforts, with increased scrutiny now affecting visa applicants, international students, exchange visitors, and even lawful permanent residents (green card holders). According to recent reports, some green card applications have been placed under a “temporary pause” to allow for additional vetting measures.
Secretary of State Marco Rubio recently issued a directive to consular officers outlining stricter screening protocols for certain nonimmigrant visa applicants, including students and exchange visitors. Effective immediately, applicants in the F, M, or J visa categories must be referred to the Fraud Prevention Unit (FPU) for mandatory social media screening if they meet any of the following criteria:
Consular officers are instructed to examine whether an applicant’s social media presence or public statements indicate support for terrorist organizations, or reflect hostile views toward U.S. institutions, values, or culture. Even constitutionally protected speech may be flagged for further review under these expanded criteria.
This heightened scrutiny goes beyond visa applicants. Lawful permanent residents have also been subject to enforcement actions under INA § 237(a)(4)(C)(i), which permits the Secretary of State to determine—without a criminal conviction or formal charges—that an individual’s presence may compromise a “compelling U.S. foreign policy interest.”
This provision has been used to justify the detention or removal of individuals based solely on their associations, speech, or political beliefs, raising significant concerns for those with otherwise lawful status.
