As was widely anticipated, on Friday, August 23, 2024, 16 states filed a lawsuit in the Eastern District of Texas challenging the legality of the Biden-Harris Parole in Place policy. This is Texas v. United States Department of Homeland Security, case number 6:24-cv-00306. While the case has only just been filed, and is likely to go through a very lengthy legal process before reaching a final conclusion, that the program has been challenged emphasizes the need to file a Parole in Place program early if one is going to take advantage of this program.
As of the time of this writing, the government has attempted to “stay” the briefing on the matter pending additional materials being provided on an expedited basis to establish (or show a lack of) standing for the States in this case. With the case only being active for two business days, there has been a lot of movement, and I think we can expect a rapid legal fight on this topic in the coming weeks. In the meantime, USCIS will continue to accept Parole in Place applications, and there has been word that some people have already received approvals for their applications.
