Worksite enforcement cases are clearly on the rise and the potential sanctions for employers go well beyond civil fines. Joseph & Hall P.C. successfully defended a corporate client today after the client received a Notice of Proposed Debarment which would have prevented the client from entering federal contracts. The client had previously settled a worksite enforcement case with Immigration and Customs Enforcement and had entered into a settlement agreement with ICE to pay fines in full resolution of the matter. The client was then later served a notice of proposed debarment which would have prevented the client from entering into any federal contracts. For this client, federal contracts represent 50-60{b6b8f04f7bd4b863c4cfed8339fd19419bda3e071c79bc5ac8c810cb9c52e30f} of the client’s revenues and millions of dollars annually. By demonstrating the work that Joseph & Hall P.C. and the client had put into bringing the client’s employer compliance practices up to best practices standards, the federal debarment official was satisfied that the client was presently responsible and removed the client from the proposed debarment list and dismissed the proposed debarment. The case was resolved in 19 days from the date the client received the notice of proposed debarment.
