Employment-Based Visa Wastage (Madhavan v. Jaddou)

Update 7-8-2022 – Click here.

Our lawsuit has begun. A few hours ago we filed our complaint in Madhavan v. Jaddou in the US District Court for the Western District of Washington. You can view a redacted copy of the complaint here.

This complaint includes all of you who signed up before the June 24 deadline. Those of you who signed up afterward will be included when we file an amended complaint in a few weeks to add plaintiffs.

What’s next?

We are now working on getting the complaint officially “served” to the government defendants. The government then has 60 days to answer our complaint. Their answer will probably be a request to dismiss the case, and we’ll have an opportunity to reply.

In the meantime, we hope that USCIS will take the lawsuit as motivation to get your applications moving or to negotiate a settlement. We’ve already had several folks drop out of the lawsuit because their applications were approved, so we hope to have more good news from more of you soon.

How do I get more information about the case, and how do I share updates about my case?

We will keep you updated by email when there are important developments, and we will be available to answer your questions most weeks via our Youtube channel livestreams at 12:00 pm Eastern.

A friendly reminder that we cannot answer your case-specific questions and you have not hired us to represent you in your individual adjustment of status applications.

We will soon send a link for a web form that you can use to share updates about the progress of your application.

Thank you again for your confidence in us and your patience. We’re proud to fight for your rights and look forward to sharing more news soon.
