Join Our Immigrant Visa Ban Litigation

Thank you for your interest in our immigrant visa ban litigation. We are getting ready to challenge the April 22, 2020 immigrant visa ban contained in Presidential Proclamation 10014. Our case will cover all of the affected categories – DV (both 2020 and 2021), Family, and Employment.

Over the summer, we sued in Aker v. Trump and sought to overturn the Proclamation in the DC District Court. We had a partial win, getting over 9,000 visas reserved for DV winners who otherwise would have lost their right to a visa. However, we did not win on getting the Proclamation overturned and that aspect of the decision is currently on appeal. [Note that if you are a DV-2020 winner, you need to read our FAQ to see if you are eligible to participate in this case].

What has changed is that an important case called the National Association of Manufacturers v. Department of Homeland Security was decided last week by a judge in the Northern District of California. In the NAM case, the judge found the nonimmigrant visa ban from June to be unlawful based on precedent from the 9th Circuit. We think with that decision, we will have a better chance to get the April ban completely overturned by filing in a new case in that court.

We hope to file the case by the middle of the month and will close out accepting plaintiffs and will start a waitlist at that point. Later on, we may file an amended complaint with plaintiffs on the waitlist. But we cannot guarantee this will be the case.
