Jain v. Mayorkas (EB-5 Regional Center Litigation 2022)

Good news! Our team has filed our lawsuit in the US District Court for the Northern District of California. The case is called Jain v. Mayorkas, and the case number is 3:22-cv-02288. We’ve been assigned to Judge Sallie Kim. We’ll send you a link with a copy of the complaint later today or tomorrow evening.

What’s next?

We are now working on getting the complaint officially “served” to the government defendants. The government then has 60 days to answer our complaint. Their answer will probably be a request to dismiss the case, and we’ll have an opportunity to reply.

In the meantime, we hope that USCIS will take the lawsuit as motivation to get your petitions moving. We will be in touch with the government attorneys, and depending on what we learn about how USCIS is handling your cases, we will strategize about our possible next steps.

How do I get more information about the case, and how do I share updates about my case?

We will keep you updated by email when there are important developments, and we will be available to answer your questions most weeks via our Youtube channel livestreams at 12:00 pm Eastern.
