Exciting News: New Protections for Undocumented Spouses and Dreamers!

We are thrilled to share some life-changing news that could significantly impact many families and individuals within our community.

Keeping American Families Together

President Biden has announced that the Department of Homeland Security (DHS) will take new measures to ensure that U.S. citizens with noncitizen spouses and children can keep their families together. This groundbreaking initiative will allow certain noncitizen spouses and children to apply for lawful permanent residence—status that they are already eligible for—without leaving the country.

Key Details:

  • Eligibility Criteria:
    • Must have resided in the United States for 10 or more years as of June 17, 2024.
    • Must be legally married to a U.S. citizen.
    • Must satisfy all applicable legal requirements.
  • Application Process:
    • DHS will assess applications on a case-by-case basis.
    • Approved applicants will have a three-year period to apply for permanent residency.
    • They will be allowed to stay with their families in the United States and be eligible for work authorization for up to three years.

Easing the Visa Process for U.S. College Graduates, Including Dreamers

In addition, today’s announcement includes measures to streamline the work visa process for individuals, including DACA recipients and other Dreamers, who have earned a degree from an accredited U.S. institution and have received an offer of employment in a related field.

  • Individuals who have graduated from a U.S. college or university and have a high-skilled job offer can more quickly receive work visas.
