The U.S. immigration process is complex. Figuring one’s way can be as confusing and frustrating as going through a maze. This is because the process is paperwork-heavy, and one must comply with a myriad of rules and regulations just to get something very basic done, such as obtaining a visa. At Joseph & Hall, P.C., we have Salida immigration lawyers who help clients successfully navigate this complex immigration system.
The United States Citizenship and Immigration Services (USCIS) is charged with the responsibility to administer our country’s naturalization and immigration system. This responsibility is shared with another agency known as the United States Immigration and Customs Enforcement (ICE). The State Department also plays a role in the immigration system.
The immigration process usually starts with either someone or an employer acting as a sponsor filing a petition with USCIS to have a relative or foreign worker be given a green card or visa to come and work in the United States.
In some cases, the petition is filed concurrently with an application for the relative or foreign worker to get their green card if they are in the United States. In other cases, the petition must be approved first before the application for a green card is filed. The difference between concurrently filing a petition and application or filing the petition first can be months of waiting and sometimes years.
If you have a sponsor and are in the United States, and your sponsor’s petition is approved, you can have your green card processed here. However, in some cases, you may be required to leave the country to complete the process at a US consulate in your native country.
Consular processing is also necessary for those residing outside the United States, but their petitions will first need to be filed at the USCIS office with jurisdiction over where the petitioner is based or lives.
